DMCA Policy Overview

MR SWAP respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for responding to claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

What This Policy Covers

⚠️ Important Note

Due to the decentralized nature of blockchain technology, some content may be permanently stored on IPFS or the blockchain even after removal from our platform interface.

  • • Content that infringes on intellectual property rights
  • • Unauthorized use of celebrity names or likenesses
  • • Copyrighted music, videos, or other media

✅ Acceptable Content

  • • Original artwork and designs you created
  • • Public domain images and content
  • • Content you have explicit permission to use
  • • Creative Commons licensed material (with proper attribution)
  • • Fair use content (limited circumstances)

DMCA Takedown Process

📧 Filing a DMCA Notice

If you believe your copyrighted work has been infringed, send a DMCA notice to:

📝 Required Information

Your DMCA notice must include:

  1. Your physical or electronic signature
  2. Identification of the copyrighted work claimed to be infringed
  3. Identification of the infringing material and its location on our platform
  4. Your contact information (address, phone, email)
  5. A statement of good faith belief that use is not authorized
  6. A statement that the information is accurate and you're authorized to act
  7. Statement made under penalty of perjury

⚡ Our Response Process

  1. We review your DMCA notice within 24-48 hours
  2. If valid, we remove or disable access to the infringing content
  3. We notify the user who posted the content
  4. We provide the user with your DMCA notice
  5. The user may file a counter-notification

⚠️ False Claims Warning

Filing false DMCA claims is perjury and may result in legal consequences. Only file DMCA notices if you have a good faith belief that the content infringes your copyright.

Counter-Notification Process

If you believe your content was wrongly removed due to a DMCA claim, you may file a counter-notification to have it restored.

Your counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the removed content and its former location
  3. Statement under penalty of perjury that removal was due to mistake or misidentification
  4. Your name, address, and phone number
  5. Statement consenting to jurisdiction of federal court
  6. Statement that you'll accept service of process from the complainant

🔄 Restoration Process

  1. We review your counter-notification
  2. We forward it to the original complainant
  3. If no lawsuit is filed within 10-14 business days
  4. We may restore the content to the platform

Repeat Infringer Policy

🚫 Account Termination

MR SWAP will terminate user accounts that are subject to repeated DMCA takedown notices. We maintain a record of all DMCA notices and counter-notifications.

⚠️ Warning System

  • • First violation: Content removal + warning
  • • Second violation: Temporary account suspension
  • • Third violation: Permanent account termination
  • • Severe violations: Immediate termination

📊 Appeal Process

Users may appeal account terminations by providing evidence that the DMCA claims were invalid or that they have resolved the copyright issues. Appeals should be sent to support@mrswap.fun
